By creating an account, accessing, or using Refurb Calculator, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and Help Build Ltd.

If you are using the Service on behalf of a company or organization, you represent and warrant that you have the authority to bind that entity to these terms.

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.

3. Description of Service

Refurb Calculator is a web-based application that provides cost estimation tools for property refurbishment projects. Our Service includes:

• Interactive cost calculation tools
• Build cost data storage and management
• PDF report generation
• User account management
• Customer support services

4. User Accounts

4.1 Account Registration

To use our Service, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your account information
• Keep up to date with payment plans if on a subscription package

4.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account or any other breach of security.

4.3 Account Termination

You may terminate your account at any time by contacting our support team. We reserve the right to suspend or terminate accounts that violate these terms or for any other reason at our sole discretion.

5. Subscription Plans and Billing

5.1 Payment Terms

• All prices include VAT where applicable
• Payments are processed securely through Stripe
• Subscriptions auto-renew unless cancelled (this must be 14 days prior to your next due payment date)
• Price changes will be communicated 30 days in advance

5.2 Refunds and Cancellations

• Monthly/Yearly Subscriptions: Cancel anytime, but no refund is given for partial billing periods.
• Lifetime Access: Includes a 14-day money-back guarantee from the purchase date.
• Refunds processed within 5-10 business days
• No refunds are available where the Service is misused or the Terms are violated

Cooling-off Period:
When you purchase a subscription or lifetime access, the Service is available to you immediately upon payment. By starting to use the Service within the 14-day statutory cooling-off period, you expressly request that we begin providing the Service straight away, and you acknowledge that you waive your right to cancel and obtain a refund once access has been granted.

If you do not access the Service during the 14-day cooling-off period, you may still cancel within that period for a full refund.

This does not affect your statutory rights if the Service is faulty, not as described, or otherwise fails to meet legal standards.

6. Acceptable Use Policy

6.1 Permitted Uses

You may use our Service for:

• Legitimate property development cost estimation
• Personal or business refurbishment planning
• Educational purposes related to construction costs

6.2 Prohibited Activities

You agree that you will not, and will not permit any third party to:

• Use the Service for any illegal purposes
• Copy, reproduce, duplicate, download, scrape, or systematically extract any part of the Proprietary Content, including but not limited to source code, pricing data, rate tables, calculation logic, or output templates
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, data structures, or trade secrets of the Platform by any means, including through use of browser developer tools, network traffic inspection, automated scripts, or manual reconstruction
• Use the Platform, its outputs, or any information obtained from it to build, develop, assist in building, or contribute to any competing product, service, tool, or application that provides property refurbishment cost estimation or similar functionality
• Share, distribute, publish, or make available any Proprietary Content to any third party, whether for commercial or non-commercial purposes
• Use automated tools, bots, scrapers, or scripts to interact with the Platform or extract data from it, beyond normal use of the calculator through the web interface
• Create an excessive number of calculations, projects, or exports beyond what is reasonably required for genuine property refurbishment estimation purposes
• Access or attempt to access any part of the Platform, its servers, or its infrastructure that is not intended for public access, including administrative areas, API endpoints not documented for user access, or server-side resources
• Sub-license, resell, rent, lease, or otherwise commercially exploit your access to the Platform or its outputs without our prior written consent
• Share account credentials with unauthorised users
• Upload malicious code or attempt to hack the system
• Use the Service to harass or spam other users

6.3 Fair Use Policy

Help Build Ltd reserves the right to monitor usage patterns of Refurb Calculator to ensure fair and appropriate use of the Service.

Your subscription is intended for a single user only. We strictly prohibit the sharing of login credentials or concurrent access by multiple individuals under a single account.

If we reasonably suspect that your account is being accessed by unauthorised users or shared among multiple individuals, we may:

• Temporarily limit usage of the Service
• Introduce a monthly cap on usage without prior notice
• Request clarification or proof of legitimate use
• Immediately suspend or permanently terminate the account

Abuse of our Service by circumventing this policy will result in the loss of access without refund, at our sole discretion. This measure is to ensure fair access for all paying users and to maintain the performance and integrity of the platform.

Lifetime Founder access will have unlimited usage for life providing the user follows our Terms of Services and in particular Fair use policy (6.3)

Subscription plans currently include unlimited usage. This is subject to review and Help Build Ltd have the right to implement usage limits without notice.

7. Intellectual Property Rights

7.1 Our IP Rights

All Proprietary Content is and remains the exclusive property of Help Build Ltd. Your subscription or trial grants you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purpose only: estimating property refurbishment costs for your own projects.

Nothing in these terms transfers any intellectual property rights to you. Your use of the Platform does not grant you any ownership of, or rights in, the Proprietary Content beyond the limited licence described above.

7.2 Permitted Use of Outputs

You may use PDF schedules of works, Excel exports, and contractor tender documents generated by the Platform for the purpose of your own property refurbishment projects, including sharing these documents with contractors, lenders, and other professionals involved in your specific projects.

You may not use outputs to reconstruct, approximate, or reverse engineer the underlying pricing data, rates, or calculation logic of the Platform.

7.3 Monitoring and Enforcement

We reserve the right to monitor usage patterns to detect potential breaches of these terms, including the volume and frequency of calculations, exports, and API requests associated with your account.

If we reasonably believe that you are using the Platform in breach of these terms, we reserve the right to immediately suspend or terminate your account without notice or refund, revoke access to all Platform features and data, retain records of your activity as evidence for potential legal proceedings, and pursue legal remedies including injunctive relief and damages under applicable UK law.

Account termination under this clause is not subject to any refund or cooling-off period, regardless of the subscription type or remaining term.

7.4 User Content

You retain ownership of any project data you input into our Service. By using our Service, you grant us a limited license to process and store your data to provide the Service.

7.5 Feedback

Any feedback, suggestions, or ideas you provide may be used by us without compensation or attribution.

7.6 Survival of IP Obligations

The restrictions and obligations relating to Proprietary Content survive the termination or expiry of your account. Your obligation not to use, disclose, or exploit any Proprietary Content obtained during your use of the Platform continues indefinitely after your account is closed.

8. Data Protection and Privacy

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms part of these terms.

9. Service Availability

9.1 Uptime

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. Planned maintenance will be notified in advance where possible.

9.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our Service with reasonable notice. We will provide at least 30 days' notice for significant changes affecting paid users.

10. Disclaimers and Limitations

10.1 Limitation of Liability

To the maximum extent permitted by law, Help Build Ltd total liability to you for any claims arising from these terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

We do not exclude or limit liability for death, personal injury caused by negligence, or any liability which cannot legally be excluded.

10.2 Exclusions

We exclude liability for:

• Any reliance on cost estimates for actual projects
• Financial losses from property decisions
• Indirect, consequential, or special damages
• Data loss due to your actions
• Third-party services or content

11. Indemnification

You agree to indemnify and hold harmless Help Build Ltd, its directors, officers, and employees from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these terms, any unauthorised use of the Proprietary Content, or infringement of any rights of another party.

12. Governing Law and Disputes

12.1 Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.

12.2 Dispute Resolution

Before initiating legal proceedings, we encourage you to contact us to resolve any disputes amicably. We are committed to working with you to find fair solutions.

13. Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, or cyber attacks.

14. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15. Changes to Terms

We may update these terms periodically to reflect changes in our Service or legal requirements. We will notify users of material changes by:

• Email notification to registered users
• Prominent notice on our website
• In-app notification upon login

Continued use of the Service after changes take effect constitutes acceptance of the new terms.

16. Assignment

We may assign our rights and obligations under these terms to any party without your consent. You may not assign your rights without our written consent.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Help Build Ltd regarding your use of the Service.
